This Client Update includes amendments to the legislation of the Republic of Kazakhstan in November 2011
The Republic of Kazakhstan has adopted 313 regulatory legal acts in November 2011 among which are:
•\tLaws – 15;
•\tDecrees of the President of the Republic of Kazakhstan – 11;
•\tResolutions of the Government of the Republic of Kazakhstan – 68;
•\tand other regulatory legal acts.
Almost all of these regulatory legal acts concern a public sector and are related to introduction of amendments into existing regulatory legal acts with no concern of a private sector.
We would like to draw your attention to the following regulatory legal acts:
Law of the Republic of Kazakhstan dated 21 November 2011 No. 494-IV “On ratification of the Treaty on Customs Union Functioning within a framework of multilateral trade system”
By adopting this Law, the Republic of Kazakhstan has ratified the Treaty on Customs union functioning within a framework of multilateral trade system. The Republic of Belarus, Republic of Kazakhstan and Russian Federation being the members of the Customs union have signed the Treaty with regard to their planned entry to WTO.
Decree of the President of the Republic of Kazakhstan dated 29 November 2011 No. 187 “On establishing of Horgos-Vostochnye Vorota Special Economic Zone”
Pursuant to this Decree it was resolved to establish Horgos-Vostochnye Vorota Special Economic Zone for the period until 2035. This Special Economic Zone is established for the following reasons:
1) Creation of traffic logistic and industrial centre;
2) Implementation of Kazakhstani products integration into world production system;
3) Generation of congenial investment climate and attraction of domestic and foreign investments etc.
Decree of the President of the Republic of Kazakhstan dated 29 November 2011 No. 186 “On establishing of Pavlodar Special Economic Zone”
Pursuant to this Decree it was resolved to establish Pavlodar Special Economic Zone for the period until 01 December 2036. This Special Economic Zone is established for the following reasons:
1) Development of chemical, petrochemical industries;
2) Development and realization of leap-ahead investment projects;
3) Implementation of Kazakhstani products integration into world production system etc.
Decree of the President of the Republic of Kazakhstan dated 25 November 2011 No. 183 “On appointment and Dismissal of Chairmen, Chairmen of Judicial Boards and Judges of the Courts of the Republic of Kazakhstan”
Pursuant to this Decree, the following changes took place within the court system of the Republic of Kazakhstan:
1) Mr. Smagulov Mukhtar Kerimkulovich was appointed as chairman of Atyrau Oblast court with dismissal from the position of chairman of the Western Kazakhstan Oblast court;
2) Mr. Alanov Jaksylyk Rzabekovich was appointed as a judge of Astana city court with dismissal from the position of chairman of Atyrau Oblast court due to expiration of term of office;
3) Mr. Tulegenov Agisbek Tursynovich, the judge of Aktobe Oblast court was dismissed from his position due to non-fulfillment of requirements presented to judges in the Republic of Kazakhstan.
