Our Dispute Resolution and Litigation practice lawyers successfully represented European Oil Company i.e. the Client’s interests at court proceedings on the claim of its former employee to nullify the order on termination of the labor contract in lieu of re-employment and payment for the period of enforced absence in the court of first instance.
The Claimant argued that some of the Client’s employees repeatedly exerted pressure and were misleading the Claimant while signing the agreement of termination of the labor contract, which impacted the Claimant’s decision to terminate the labor contract with the Client. Moreover, the Claimant in her claim indicated, that she did not have a 3-day period for examination and consideration of proposal of the termination of the labor contract.
According to the results of comprehensive trial and interviews of witnesses, the court supported the Client’s position and ruled that the Client, acted in full compliance of the labor laws requirement by terminating labor contract by mutual agreement of the parties and didn’t threaten, force or mislead the Claimant.
