Sergazy is an Associate in SIGNUM’s Dispute Resolution and Litigation practice. He focuses on commercial and administrative disputes, litigation, enforcement proceedings, and the recognition and enforcement of foreign court judgments and arbitral awards.

He advises and represents international and Kazakhstan clients in civil and administrative proceedings, debt recovery matters and international arbitration, as well as disputes involving tax, customs, employment, competition, contract and intellectual property law.

His experience includes representing clients before courts, government authorities and private bailiffs, challenging administrative acts, and advising on rehabilitation, bankruptcy and enforcement matters.

Before joining SIGNUM, Sergazy completed an internship in the legal department of an international company, where he worked on debt recovery matters.

Sergazy has rights of audience before the AIFC Court and is a member of the Kazakhstan Bar Association KazBar and the Young Lawyers Committee of the International Arbitration Centre.

He is fluent in Kazakh, Russian and English.

Selected Experience

  • Debt Recovery. Represented a major financial company in disputes concerning recovery of debts from lessees and guarantors, including a claim of approximately USD 600,000, as well as matters involving invalidation of transactions, recovery of leased assets and interaction with debtors and private bailiffs.

  • Recognition and Enforcement of Foreign Judgments and Arbitral Awards. Represented a leading international industrial gases and engineering company in enforcement proceedings relating to a foreign court judgment and issuance of an enforcement writ for approximately EUR 1 billion. Also handled matters involving recognition and enforcement of foreign arbitral awards and court judgments, including decisions from Belarus and the Netherlands.

  • International Arbitration. Represented a foreign company in arbitration proceedings in Kazakhstan concerning recovery of an advance payment under a supply agreement.

  • Tax Disputes. Represented a leading international industrial gases and engineering company in a dispute with the State Revenue Department of Temirtau concerning the validity of a contract.

  • Employment Disputes. Advised a client on a potential employment dispute involving the application and enforceability of a non-solicitation clause and represented a client in litigation concerning the validity of an employment agreement and related financial claims.

  • Competition Disputes. Represented an IT company in proceedings challenging an order of the competition authority to initiate an investigation.

  • Public Procurement. Represented a leading international industrial gases and engineering company in proceedings concerning its removal from the register of unreliable potential suppliers of the Samruk-Kazyna group.

  • Intellectual Property. Represented a major international manufacturer of personal care and paper products before the Appeals Board of the Ministry of Justice in a trademark invalidation dispute and prepared legal opinions on trademark protection matters.

  • Customs Regulation. Advised a major international automotive company and a leading US footwear manufacturer on customs regulation and compliance with Kazakhstan law.

  • Regulatory Compliance. Advised a major chemical company on product recall requirements in Kazakhstan.

  • Commercial Contracts. Assisted with the preparation of contractual documentation for a leading international cosmetics manufacturer.

  • Rehabilitation and Bankruptcy. Advised Kazakhstan and international clients on rehabilitation, insolvency and bankruptcy matters, including creditor-protection and debt-recovery mechanisms.

  • Enforcement Proceedings. Advised clients on civil and administrative enforcement proceedings, including enforcement of court decisions, interaction with private bailiffs and challenges to bailiff actions.

  • Challenges to Government Actions. Advised and represented clients in proceedings challenging decisions and actions of government and administrative authorities.

Public speaking

Sergazy actively participates in academic and professional initiatives related to dispute resolution, international arbitration and the development of the legal profession. He delivers guest lectures for students at leading universities in Kazakhstan and contributes to educational initiatives aimed at developing practical advocacy and dispute-resolution skills.

His recent activities include:

  • Guest Lectures at Leading Kazakhstan Universities. Delivered lectures at SDU University, Narxoz University, Al-Farabi Kazakh National University and Ablai Khan University of International Relations and World Languages on various areas of law, as well as on the legal profession and the role of a legal adviser.

  • Moot Court Initiatives. Participated in organising moot court competitions for students of Nazarbayev Intellectual Schools and other schools.

  • IAC Central Asia Vis Pre-Moot. Served as an arbitrator in the preliminary rounds of the international student arbitration competition organised by the AIFC International Arbitration Centre.
