Our lawyers successfully represented client in the number of civil cases, related to the dispute between the adjacent (neighboring) subsurface user, on the one hand, and the client and competent authorities, on the other hand. Dispute concerning the title for the contract area due to the oilfield location at the contract areas of two subsurface users (the client and the adjacent subsurface user) was a subject of court proceedings.

Within the litigation process, our lawyers developed strategy of this case, made detailed legal review and case assessment, participated in settlement working meetings and represented the Client in the court of the first instance and in the appeal process.

The main provisions, governing questions of adjacent subsurface users are established by the Law of RK «On subsurface and subsurface use», however, in the process of work on this matter there was a number of outstanding issues, both procedural, and legal and commercial. Anyway, this experience is unique on its essence, and our lawyers gained invaluable experience in negotiating and court representation on such complex matter.
